SmartCell™ 1.0 SMS License Agreement

SmartCell™ V1.0 trial version is free for non profit evaluation use. The commercial user can register their copy to get commercial license. The commercial license issued for SmartCell™ V1.0 is a license to USE this product on ONE computer or MULTIPLE computer or DISTRIBUTION with your application as per license types mentioned below:

TRIAL

Entitles unlimited use of SmartCell™ with all features on one single computer. The trial version adds an advertisement signature at the end of every text message that is sent out. Additionally it accepts the first 20 characters of the message you want to send. Also note that it does not allow you to split a long message into multiple parts to send. Character encoding features are not enabled in the trail version. Does not entitle you to rent, lease or distribute SmartCell™ either as standalone or bundled with an application.

STANDARD
Entitles you to install SmartCell™ Std for developing and using application based on SmartCell™ Std on one or multiple computers within one single geographical premises of an organization/company/enterprise. The features available are that of SmartCell™ Std version as mentioned on our website www.indi-soft.com. Does not entitle you to rent, lease or distribute SmartCell™ either as standalone or bundled with an application.

PROFESSIONAL
Same as STANDARD plus it gives you the additional rights to rent, lease or distribute an unlimited number of licenses of SmartCell™ Pro (Indisoft.dll) outside your organization bundled with an application.
The commercial user is granted a non-exclusive license to use SmartCell™ v1.0 on as many computers as defined by the licensing terms above according to the type of licenses purchased, for any legal purpose. The registered version of SmartCell™ v1.0 may not be rented or leased, but may be permanently transferred, in its entirety, if the person receiving it agrees to the terms of this license. If the software is an update, the transfer must include the update and all previous versions.
The installation package may be freely distributed, with exceptions noted below, provided the distribution package is not modified in any way. You are allowed to distribute SmartCell™ v1.0 through the Internet, BBSs, Shareware distribution libraries, CD-ROMs and Magazine Cover Media. You may charge a distribution fee for the package, but you must not represent in any way that you are selling SmartCell™ v1.0 itself. No person or company may distribute separate parts of the package without written permission of Indisoft. The evaluation version may not be distributed inside of any other software package without written permission of Indisoft. Hacks/crack, keys or key generators may not be included on the same distribution.
SmartCell™ v1.0 is distributed "as is". No warranty of any kind is expressed or implied. You use at your own risk. Neither the author nor the agents of the author will be liable for data loss, damages, loss of profits or any other kind of loss while using or misusing this component. You agree to defend, indemnify, and hold Indisoft and all of its employees, agents, representatives, directors, officers, partners, shareholders, attorneys, predecessors, successors, and assigns harmless from and against any and all claims, proceedings, damages, injuries, liabilities, losses, costs, and expenses (including reasonable attorneys fees and litigation expenses), relating to or arising from your use of SmartCell™ v1.0, or any breach of this Agreement, except to the extent such claim relates to or arises from a violation by Indisoft of any third party copyright, trademark, trade secret or other intellectual property right.

You may not use, copy, emulate, clone, rent, lease, sell, modify, decompile, disassemble, otherwise reverse engineer, or transfer the licensed program, or any subset of the licensed program, except as provided for in this agreement. You may not modify the program or documentation files in any way. You must include all the files that were in the original distribution. You may not decouple or otherwise reduce SmartCell™ v1.0 to a human perceivable form. You may not sell SmartCell™ v1.0 or charge a registration fee, except to recover the media costs. Any such unauthorized use shall result in immediate and automatic termination of this license and may result in criminal and/or civil prosecution.

Installing and using SmartCell™ v1.0 signifies acceptance of these terms and conditions of the license. If you do not agree with the terms of this license you must remove SmartCell™ v1.0 files from your storage devices and cease to use the product.
